The consumer Customer has no right of withdrawal because the Products are personalized.
5.1 The following delivery times apply:
(i) For items available for delivery in Guyana, the dispatch time is usually 2 to 4 working days from the day following that of receipt of payment for the order.
(ii) Deadlines for items available for delivery in a country other than France, the shipping deadline is 4 to 10 working days from the day following that of receipt of payment for the order.
5.2 If the order cannot be honored within a maximum period of 30 working days, from the day following that of the validation of the order by the Customer, the latter has the right to cancel his order. For orders for which the summary sent to the Customer specifies 'available within x weeks', the maximum delivery time is 30 working days increased by the number of weeks in question.
5.3 These deadlines are communicated for information purposes only and additional deadlines may apply during promotional periods. Nevertheless, Phare Est Productions will make every effort to ensure that delivery times are respected, as far as possible.
5.4 Delivery is made by LA POSTE to the delivery address indicated when confirming the order or as indicated on the order form by the Customer.
5.5 The delivery is presumed accepted when it has not been the subject of any reservations by the Customer.
5.6 In the event that the delivery is made to the premises of Phare Est Productions, the Customer announces his arrival for the collection of the Product(s) 24 hours in advance. The Customer is solely responsible for securing his load and the maximum weight supported by the means of transport used. Under no circumstances may Phare Est Productions be held responsible for the loss and/or degradation of the Product(s) during transport or for any damage caused to the means of transport.
5.7 In accordance with the law and the Incoterm 2010 Ex Works (EXW), the transfer of risk takes place at the time of delivery. It is up to the Customer to check the conformity of the Product(s) (condition, characteristics, absence of defect, quantity, etc.) at the time of receipt, in the presence of the carrier or, where applicable, a designated person. for this purpose in the premises of Phare Est Productions. Any dispute relating to the conformity of the Product(s) delivered must be indicated (i) directly to Phare Est Productions as well as (ii) on the delivery note and communicated to the carrier or the person designated for this purpose. by Phare Est Productions as soon as possible.
5.8 The resale of the Product(s) or the use of part of it automatically entails the approval of the whole.
5.9 Without prejudice to the foregoing, any defects in part of the delivery do not entitle the Customer to refuse the entire supply.
5.10 The Customer may refuse delivery of the Product(s) by means of:
- compensation of 20% of the price of the order; Where
- a just reason, attributable to the gross negligence of Phare Est Productions.
